Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Chandauti P.S. Case No. 307 of 2021 registered for the offences punishable under Sections 25 (1-B)a and 26 of the Arms Act. Allegedly, on seeing the police party the accused persons who stood near a motorcycle tried to flee but the petitioner who was one of them was apprehended and other coaccused persons managed to escape and from the possession of this petitioner one loaded country-made pistol and a motorcycle were recovered.

No.43037 of 2022(2) dt.22-11-2022 2/2 The main submissions advanced by the learned counsel Mr. Deepak Kumar for the petitioner are that the petitioner has clean antecedent and has been languishing in jail since 21.09.2021 and against him the investigation has been completed.

Learned APP Mr. Rana Randhir Singh appearing for the State has opposed the bail prayer.

In view of above submissions and mainly considering the petitioner's custody period and his clean antecedent and also the fact that against him the investigation has been completed and his case is at initial stage, in the opinion of this Court a lenient approach can be taken in respect of the petitioner's prayer, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Chandauti P.S.
