The petitioners seek bail in connection with Dagarua P.S. Case No.135 of 2017 registered under Section 393 of the Indian Penal Code.

The petitioners are said to have tried to plunder the tempo of the informant after getting it on the hire. It is submitted by learned counsel for the petitioners that there was dispute between the petitioners and the informant over payment of toll tax and the informant was liable to pay the same as the petitioner had hired his tempo on the fare including the toll tax and over the said dispute, the informant assaulted the

Patna High Court Cr.Misc. No.52797 of 2017 (3) dt.12-12-2017 2/2 petitioner and the police after getting him treated in the PHC lodged this false case at the instance of the informant. Petitioners have been languishing in jail custody since 4.08.2017. They have no criminal antecedent.

In the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-2nd, Purnea in connection with Dagarua P.S.
