JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-10-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Baisi P.S. Case No. 107 of 2017 for the offences punishable under Sections 147, 148, 149, 341, 323, 332, 324, 307 and 379 of the Indian Penal Code.

The allegation against the petitioner is that of forming an unlawful assembly with other accused persons and assaulting the informant side with iron rod, Danda, Lathi etc. and as far as the petitioner is concerned, he is said to have given farsa blow on the head of the informant on account of which the informant received injury. It is stated that the injury inflicted by the petitioner is simple in nature.

The learned counsel for the petitioner submits that

No.50070 of 2017 (2) dt.17-10-2017 2/2 the present case is a counter case to the case filed by him against the informant side and the entire incident arises out of a land dispute. The petitioner has also been injured in the said occurrence and as far as the petitioner is concerned, he has a clean antecedent and he is in custody since 26.07.2017.

In the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea in connection with Baisi P.S. Case No. 107 of 2017. (Mohit Kumar Shah, J) BTiwary/- U T
