The petitioner seeks bail in connection with Hathua P.S. Case No. 45 of 2017 dated 26.03.2017 instituted for the offences punishable under Sections 326, 307, 353, 332, 333 and 34 of the Indian Penal Code read with Section 27 of the Arms Act. From perusal of the FIR and from the submissions made on behalf of the petitioner, it appears that with respect to one occurrence, three FIRs have been lodged. The petitioner along with another is alleged to have fire at the police party. However, in the darkness, it could not be ascertained by the informant, Munna Chaudhary, as to who had fired.

Be that as it may, only the petitioner was apprehended at the spot from whose possession weapons were

Patna High Court Cr.Misc. No.51524 of 2017 (3) dt.24-11-2017 recovered. He is said to have disclosed the name of Ritesh Tiwary as his associate who had manage to run away.

The petitioner has been granted bail in other two cases which arise out of same occurrence. Co-accused Ritesh Tiwary has also been granted bail by the court below. The petitioner is in custody since 10.04.2017. In the facts and circumstances, the petitioner above named is directed to be released on bail on his furnishing bail bond of with a sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Hathua P.S. Case No. 45 of 2017.
