JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-11-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302, 201, 34 of the Indian Penal Code.

The prosecution case is that seven accused persons including the petitioner took meal with Vikash Kumar, elder brother of the informant. It is alleged that some altercation took place and Rahul Kumar Singh and Raju Singh assaulted the brother of the informant. It is further alleged that Rahul Kumar Singh tied towel around the neck of Vikash Kumar, who subsequently died due to of strangulation. The dead body was taken away by Ram Pravesh Singh and others. It is submitted by learned counsel for the petitioner that no overt act has been alleged against the petitioner.

Patna High Court Cr.Misc. No.53815 of 2015 (2) dt.26-11-2015 2/2 A statement has been made in para 3 of the petition that petitioner has no criminal antecedent and similarly situated co-accused has been granted anticipatory bail vide Cr. Misc. No. 48741 of 2015.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Aurangabad in connection with Kasma P.S. Case No. 61 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
