JUSTICE SATYAVRAT VERMA ORAL ORDER 10-02-2022 Heard the learned counsel for the petitioner and the learned APP for the State, through Video Conferencing. The petitioner seeks bail in connection with Supplementary Gogari P.S. Case No. 130 of 2019, G.R. No. 1050 of 2019, instituted for the offences under Section 392 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 24.03.2021, he is a person with clean antecedent, charge-sheet has been submitted and the allegation, as alleged in the FIR is that the informant on 26.04.2019 after collecting Rs. 39,000/- was proceeding from the house of Rita Devi by motorcycle, when the son of Rita Devi, namely, Prince Kumar followed him by another motorcycle and when the informant reached near Auta Kama

No.52926 of 2021(2) dt.10-02-2022 2/3 Asthan, he saw two persons were sitting with faces covered and from behind Prince shouted that the money is in the dickey of motorcycle on which both the aforesaid unknown persons surrounded him and made him seat in the middle of the motorcycle forcibly and thereafter it is alleged that face of both the accused was uncovered and he identified them as Laltu Yadav and Monu Kumar. The learned counsel further submits that petitioner has been falsely implicated in the present case and similarly situated co-accused, Monu Kumar has been granted bail by order dated 12.08.2020 in Cr. Misc. No. 22022 of 2020.

The learned A.P.P. vehemently opposes the bail application.

Considering the fact that the petitioner is in custody since 24.03.2021, charge-sheet has been submitted and similarly situated co-accused has been granted bail, the petitioner, abovenamed, is directed to be released on bail on his furnishing bailbonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Deepak Kumar, learned Judicial Magistrte, Ist Class or Successor Judicial Magistrate, Ist Class, in connection with Supplementary Gogari P.S. Case No. 130 of 2019, G.R. No.

Patna High Court CR. MISC. No.52926 of 2021(2) dt.10-02-2022 3/3 1050 of 2019, with a condition that one of the bailor shall be the wife of the petitioner (Kanchan Devi).

The application stands allowed.
