Mr.Nand Kishor Pd., APP ====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-01-2019 None appears for the petitioner. However, Mr. Nand Kishore Prasad, learned APP for the State is present. The present revision application has been filed against the order dated 13.01.2011 passed by learned Additional Sessions Judge, Fast Track Court No. 5, Saran at Chapra in Sessions Trial No. 273 of 2010, whereby the application of the petitioner, being the informant of Masrakh P.S. Case No. 111 of 2009, preferred under Section 319 of the Cr.P.C,. for summoning the opposite party nos. 2 and 3 the accused has been rejected by the learned trial Court.
It appears that the notices were issued to opposite party nos. 2 and 3 vide order dated 02.05.2018 and four weeks' peremptory time was granted to file requisites. The office note
Patna High Court CR. REV. No.325 of 2011(8) dt.03-01-2019 2/2 dated 30.06.2018 reflects that the requisites for issuance of notices were not submitted and the revision application stood dismissed for non-compliance of peremptory order dated 02.05.2018 on 18.06.2018.
In the circumstances, the present revision application has become meaningless and accordingly, it is dismissed. (Dinesh Kumar Singh, J) DKS/- U T
