The petitioners seek bail in connection with Narpatganj P.S. Case No. 429 of 2016 dated 19.12.2016 instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 307 and 302 of the Indian Penal Code.

It has been alleged in the FIR by one Birendra Singh that he and his father were assaulted by as many as fourteen accused persons leading to injuries on his person and death of his father. The informant has received seven injuries on his person; whereas the death of his father has been caused by gun shot. Learned counsel for the petitioners has submitted that because of the land dispute, the petitioners have been falsely

Patna High Court Cr.Misc. No.51561 of 2017 (3) dt.04-12-2017 named in the FIR.

Be that as it may, it has been submitted that there is no specific allegation against anyone of the petitioners and that under similar circumstances, five other accused persons have been granted bail by order dated 01.12.2017 passed in Cr. Misc. No. 43997 of 2017 by a coordinate Bench of this Court. The petitioner no. 1 is in custody since 12.06.2017 whereas petitioner nos. 2 and 3 are in custody since 17.06.2017.

Regard being had to the aforesaid facts as also that the petitioners do not bear any criminal antecedent, this Court is inclined to grant bail to the petitioners.

In the facts and circumstances, the petitioners above named are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No. 429 of 2016.
