Heard learned counsel for the petitioners and learned A.P.P. for the State.

Learned counsel for the petitioners seeks permission to withdraw the anticipatory bail application with respect to petitioner No. 3, Narayan Singh @ Ramnarayan Singh, as he left for his heavenly abode during pendency of the instant anticipatory bail application.

Permission is accorded.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 304B and 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and have been falsely implicated in the instant case by the informant. It is next submitted that informant alleges that his daughter was married to Dheeraj Singh on 11-3-2023 and after marriage, she was tortured by the accused persons as they were not ready to take her back unless a motorcycle was given by way of dowry. It is further alleged that on 26-2-2024, a call was received informing that the deceased was taken to hospital for treatment on account of ill health, accordingly he reached the place of occurrence and saw the dead body of his daughter with mark of violence on the neck.

Learned counsel for the petitioners submits that petitioners are cousin mother-in-law and cousin sister-in-law of the deceased. It is further submitted that petitioner No. 3 was grand father-in-law of the deceased and he was also implicated in the instant case by the informant in a mechanical manner. It is also submitted that petitioners are separate in mess and property with the husband of the deceased. It is next submitted that husband of the deceased is in custody.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioner Nos. 1 and 2, above named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Isuapur P.S. Case No. 61 of 2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) SUMIT/- U T
