JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-01-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 17.1.2017 passed in Cr.Misc.No. 817 of 2017 with a direction to the trial court to expedite the trial and conclude the same within a period of nine months. It appears that nine months period has expired and submission of learned counsel for the petitioner is that the case is pending for examination of the informant and further two months time was granted to the trial court to conclude the trial. However, it appears from perusal of the report submitted by the trial court that trial will be concluded within a period of two months. Heard learned APP also.
In the facts and circumstances, I am not inclined to grant bail to the petitioner at this state.

At the same time, Superintendent of Police, Banka is directed to ensure the presence of the witness in court on the date fixed so that trial be concluded within the said period. Needless to say that petitioner shall cooperate in disposal of trial. The said direction must be strictly complied by the trial court and the Superintendent of Police. With the above observation, this application is disposed of.
