This is an application for regular bail in connection with Banka P. S. case no. 635 of 2016 registered for the offences punishable under Sections 302 r/w Section 34 of the Indian Penal Code.
Informant is grand-father of deceased Rahul Kumar, who has stated in his complaint petition that on 25.06.2016 accused Brajesh Sah came to his house and offered Rahul Kumar to work with him as he was awarded a contract of electric wiring at Kharakpur and on getting such offer deceased Rahul Kumar accompanied him. However, on 03.07.2016 dead body of Rahul Kumar was brought to his house and cremated on 04.07.2016. Allegation is that accused Brajesh Sah wanted to marry sister-in-law of other accused but the girl refused to
Patna High Court Cr.Misc. No.59673 of 2017(3) dt.16-01-2018 2/2 marry him and she wanted to marry Rahul Kumar and because of that they in conspiracy killed Rahul Kumar. Petitioner is the brother-in-law of the said girl Reshmi Kumari. There is no specific allegation of committing murder of Rahul Kumar against petitioner. He has got no criminal antecedent and is in custody since 21.06.2017.
Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Banka P. S. Case no. 635 of 2016.
