JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-11-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 427, 436, 341, 323 of the Indian Penal Code, Section 17 of the Criminal Law Amendment Act and Section 27 of the Arms Act.
The prosecution case is that 20-25 miscreants entered into the room of the construction company, took construction equipments on fire and raised slogan in favour of the extremist organization leading to registration of F.I.R against 20-25 unknown. The name of the petitioner sprang up during investigation.
It is submitted by learned counsel for the petitioner that only on confession of the co-accused Rajiv Kumar, the petitioner's name sprang up and Rajiv Kumar has been granted bail by learned Court below. Moreover similarly
Patna High Court Cr.Misc. No.53816 of 2015 (2) dt.26-11-2015 2/2 situated co-accused Sanjay Patel has also been granted regular bail vide Cr. Misc. No. 2529 of 2015.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Purhaniya P.S. Case No. 25 of 2013, pending in the Court of learned Chief Judicial Magistrate, Sheohar.
With the observations above, the application stands disposed off.
