Petitioner seeks bail in Sonwarsa Raj P.S. Case No.19 of 2019 instituted for the offence under Section(s) 302/34 Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that in the written report there is allegation that Mantosh Kumar had given threat that Dilkhush (grand son of the informant) will be killed. It is alleged that on the date of occurrence informant along with his younger son got awake on hearing sound of firing. They saw the petitioner and other accused persons running away. They further saw that grandson, Dilkhush, had sustained firearm injury in his ear. It is further submitted that petitioner is father of Mantosh Kumar.

Petitioner is in custody since 18.02.2019.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa, in connection with Sonwarsa Raj P.S. Case No.19 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
