The petitioners are languishing in custody for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The petitioners are driver and cleaner of the truck on which huge quantity of liquor was recovered hidden beneath the bags of vegetable. The petitioners have stated on oath that they have got no criminal antecedent. They are in custody since 05.07.2020. Investigation of the case is already complete. Considering the facts aforesaid and no material to

No.5505 of 2021(2) dt.26-04-2021 2/2 substantiate that the petitioners are going to tamper with the evidence, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Bajpatti P.S. Case No.270 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below. (b) The petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
