The petitioner seeks regular bail in connection with Sessions Trial No. 536 of 2017 arising out of Ujiyarpur P.S.Case No. 08 of 2016 registered for offences punishable under Sections 341,386 and 307/34 of the Indian Penal Code and Section 3/4 Explosive Substance Act.
Earlier prayer for bail was rejected ON 17.05.2017 in Cr. Misc. No. 17027 of 2017 on the ground that the petitioner may renew his prayer for bail after framing of charge. Submission of the learned counsel for the petitioner is that there is absolutely nothing against the petitioner and allegation against the petitioner is vague and he is in custody since eleven months.
It has also been submitted that he is an accused in three other cases which is stated in para-3 of this petition. So far
Patna High Court Cr.Misc. No.55187 of 2017 (2) dt.22-11-2017 2/2 as this case is concerned, there is nothing against him. Hear learned A.P.P.
Perused the impugned order but no witness has been examined up till now.
Having heard both sides and in view of the facts as stated above, this appeal is allowed. Let, the appellant above named, be released on bail on furnishing bail bond of Rs. 25,000/- ( Rupees Twenty five thousand ) with two sureties of the like amount each to the satisfaction of learned Fast Track Court-II, Samastipur in connection with Sessions Trial No. 536 of 2017 arising out of Ujiarpur P.S.Case No. 08 of 2016, subject to the conditions that one of the bailors shall be close relative of the petitioner and the other the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the Court and on the event of failure on his part to appear before the Court below on two consecutive dates without showing any genuine reason, his bail bond shall be cancelled. With the aforesaid observation, this application is allowed.
