Petitioner seeks bail in a case registered for the offences punishable under Sections 304B, 302, 201/34 of the Indian Penal Code.
Petitioner is husband of the victim of dowry death. Allegation is of demand of dowry and torture for the same soon before death. Death was caused in unnatural circumstance within two years of her marriage in her matrimonial house. Submission is that petitioner is in custody since 12.10.2017.
The report of the learned Trial Judge would reveal that charges have recently been framed in this case. Considering the entire facts, let the petitioner, above named who is ready to cooperate with the trial be released on
Patna High Court CR. MISC. No.64816 of 2018(7) dt.08-05-2019 2/2 bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Salkhua Police Station Case No. 215 of 2017, with the following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below having immovable property.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Rajan/- U T
