====================================================== CORAM: HONOURABLE MR. JUSTICE MADHURESH PRASAD ORAL ORDER 05-04-2021 Heard learned Counsel for the petitioner and the learned Counsel for the State.
This Court would expect that the petitioner's Counsel would honour his undertaking in the instant proceedings regarding supply of requisite court fee etc. within two weeks from the date he is called upon to do so by the office.
Petitioner seeks bail in NDPS Case No. 18 of 2020 arising out of Sikroul PS Case No. 79 of 2020 registered under Sections 20(b)(ii)(c) and 22(b) of the NDPS Act.
There is alleged recovery of 7 grams 80 milligrams of Heroin from the petitioner.
It is submitted by learned Counsel for the petitioner that the petitioner has falsely been implicated in this case and he is in custody since 12.7.2020. It is also submitted that the substance has not been weighed properly.
Learned APP has opposed the prayer for bail. It is submitted that the quantity as per prosecution case is more than small quantity. The petitioner has antecedent of other cases of indulging in sale of other contraband substance, namely liquor under the Bihar
Patna High Court CR. MISC. No.1327 of 2021(2) dt.05-04-2021 2/2 Prohibition and Excuse Act.
Considering the rival submissions, this Court for the present is not inclined to allow the prayer for bail. The same is rejected. (Madhuresh Prasad, J) SNkumar/- U T
