The petitioner apprehends his arrest in Madanpur P.S. Case No. 23/2016 registered under Sections 414, 420, 467, 468, 471/34 of the Indian Penal Code and Sections 4, 21, 26(A), 40 of the Bihar Minor Minerals Concession Rules, 1972. The informant alleged that one truck bearing registration no. BR-02T-0846 was intercepted while coal was being unloaded. Truck Driver Rajan Kumar Choudhary and cleaner Shiv Dutt Yadav produced papers of the truck. The driver disclosed that one paper was given to him by S. Kumar, M/S Shiv Shakti Enterprises, Dhanbad, Jharkhand and another paper was given to him by Pintu Singh (the petitioner). It is submitted that save and except this, there is absolutely no evidence against the petitioner. The petitioner neither purchased the coal nor gave any

Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in Madanpur P.S. Case No. 23/2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
