ANJANA MISHRA ORAL ORDER 14-12-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody since 13.04.2017 in connection with a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the name of present petitioner has surfaced on further investigation and has been made by a witness who was not an eye-witness to the occurrence. It was in pursuance of such statement that the prosecution was started against the present petitioner and he was taken into custody. Another person (Ranjan Kumar Singh), who is also similarly placed, has since been released on regular bail in Cr.

Patna High Court Cr.Misc. No.58782 of 2017 (2) dt.14-12-2017 2/2 Misc. No. 58446 of 2017 vide order dated 12th of December, 2017 by a Bench of this Court.

Considering the aforementioned facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., XI, Siwan, in connection with Daraunda P.S. Case No. 18/2017.
