2. The petitioners have prayed for anticipatory bail in connection with Laukahi P.S. Case No. 65 of 2024, registered for the offence punishable under Sections 304B and 34 of the Indian Penal Code.
3. The case of the prosecution, in short, is that the informant's daughter, Sobha Devi, was tortured by her husband and other family members including petitioners. Petitioner No. 1, Rinku Devi, is the sister-in-law(gotni) of the deceased and Petitioner No.2, Shibji Roy, is the uncle-in-law of the deceased. The F.I.R further discloses that the informant's daughter was
Patna High Court CR. MISC. No.42946 of 2026(2) dt.13-07-2026 2/3 killed, after which her body was hanged and the information of this was given by co-villagers of accused side.

Learned counsel for the petitioners submits that petitioner no. 1, Rinku Devi's husband has already passed away in 2019 and since then she has been living separately, having no connection with the household of the deceased or the coaccused husband, Sanjiv Kumar. It is further submitted that petitioner no. 2, Shibji Roy, being the uncle-in-law, also lives separately and had less interference in the family affairs of the other accused persons named in the F.I.R.
5. He further submits that other co-accused family members has already been enlarged on anticipatory bail and the husband of the deceased, namely Sanjiv Kumar, has been granted regular bail by this Co-ordinate bench.
6. Learned APP has vehemently opposed the anticipatory bail.
7. Having considered the rival submissions, particularly the fact that the petitioners were not sent up for trial in the final police report and are separate-living relatives of the husband, and noting their clean antecedents, this Court is inclined to allow the prayer.
8. Accordingly, it is directed that the petitioners, in the
Patna High Court CR. MISC. No.42946 of 2026(2) dt.13-07-2026 3/3 event of arrest and surrender before the below Court within a period of four weeks from today, after furnishing the bail bond of Rs. Rs.10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st class, Jhanjharpur, Madhubani.
