The petitioner seeks regular bail in connection with Bondeya P. S. Case No. 12 of 2017 registered for offences punishable under Sections 341, 323, 353, 385, 427, 435, 504, 506/34 of the Indian Penal Code and Section 17 of CLA Act. The F.I.R. has been registered against unknown and the name of the petitioner has surfaced on the basis of the statement of co-accused, who was indulged in another case and on that basis, the petitioner has been implicated in this case. It is further alleged that some unidentified miscreants had set Poklane machine on fire. Learned counsel for the petitioner submits that petitioner is a laborer and there is no any other incriminating
Patna High Court Cr.Misc. No.59494 of 2017 (3) dt.15-01-2018 2/2 material against the petitioner and he is in custody since 21.06.2017. It is further submitted that similarly situated coaccused has been granted the privilege of bail by this Court vide order dated 19.09.2017 passed in Cr. Misc. No. 44177 of 2017. Considering the facts and circumstances and the materials on record, let the petitioner, above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad (Bihar) in connection with Badeya P.S.Case No. 12 of 2017.
