This application, for grant of regular bail, arises out of Teghra Police Station Case No. 393 of 2019, disclosing offences under Section 306/34 of the Indian Penal Code. The allegation, as per the First Information Report is that the son of the informant had quarrel with the petitioner on the date of occurrence and after returning back to his home, the son of the informant committed suicide.

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and the allegation against the petitioner is false and

No.40368 of 2020(2) dt.02-03-2021 2/2 misconceived inasmuch as the son of the informant (deceased) has committed suicide at his home whereas the petitioner was staying at her parental home which is 21k.m. away from the place of occurrence. Learned counsel next submits that the petitioner is second wife of the deceased and the first wife of the deceased is living separately and the deceased performed married with the petitioner about two years back. Learned counsel further submits that petitioner is in custody since 05.08.2020.

Having regard to the submissions made by the parties and taking into consideration the materials on record and the nature of allegation and the fact that petitioner is in custody since 05.08.2020, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, Rupam Devi, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Teghra Police Station Case No. 393 of 2019. sanjeev/- (Anil Kumar Sinha, J.)
