Petitioner seeks bail in Mansahi P.S. Case No. 44 of 2017 for the offence punishable under Sections 302 and 201 of the Indian Penal Code.
In the FIR, informant had stated that some unidentified persons had killed his husband. She has not named anyone in the FIR. However, subsequently in her re-statement she had made accused Mantu Mandal and Ramesh Kumar Mandal on suspicion.
It has been submitted on behalf of the petitioner that name of petitioner had surfaced in the case only on the basis of confessional statement of co-accused Mantu Mandal. Informant has claimed that some unknown persons had killed
Patna High Court Cr.Misc. No.49101 of 2017(2) dt.18-10-2017 2/2 her husband and no recovery has been made from the possession of the petitioner. Due to enmity, Mantu Mandal and this petitioner has been made accused. It has further been submitted by the learned counsel for the petitioner that the petitioner has got no criminal antecedent and is in custody since 17.07.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Mansahi P.S. Case No. 44 of 2017.
