JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-03-2017 By way of the present modification application, petitioner seeks to modify the order dated 14.01.2015 passed in Criminal Miscellaneous No. 30058 of 2014, by which the petitioner was allowed anticipatory bail till submission of chargesheet. It has been submitted on behalf of the petitioner that vide order above mentioned, the petitioner was allowed anticipatory bail till submission of charge-sheet but the charge-sheet in that particular case had already been submitted and, therefore, prayed that the order be modified.

Be that as it may, considering the submission of learned counsel for the petitioner and from perusal of the record, this Court finds that there is no need to interfere with the order aforementioned rather the petitioner should surrender before the

Patna High Court Cr.Misc. No.55463 of 2016 (2) dt.22-03-2017 2/2 court below and make above submission and the court below after verifying the facts with regard to submission of charge-sheet and after considering the materials of case diary shall pass an appropriate order, without being prejudiced by the order of this Court.

With above observation, this modification application stands disposed of.
