JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-12-2021 Heard learned counsel for the petitioners and the State. Petitioners seek regular bail in a case registered for the offence punishable under section 307 and other ancillary sections of the Indian Penal Code.

As per the prosecution case, petitioner no.1 assaulted the informant's son with farsa causing head injury, whereas petitioner no.2 assaulted one Mukesh Kumar with iron rod causing fracture injury on the hand.

Learned counsel for the petitioners submits that there is land dispute between the parties and allegation of assault is against all the 8 named accused persons and 5/6 unknown accused persons. He further submits that in fact petitioner no.2

Patna High Court CR. MISC. No.54093 of 2021(2) dt.03-12-2021 2/2 has filed Ghosi Police Station Case No. 17 of 2019 against the informant and the instant case is the counter blast of that case. Petitioners claim clean antecedent and they are in custody since 24.5.2021 and 24.4.2021 respectively. Investigation is complete.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let all the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in Ghoshi Police Station Case No. 19 of 2019.
