The petitioner is apprehending his arrest in a case registered under Sections 147, 148, 149, 323, 324, 326, 337, 338, 353, 307, 427, 379, 120(b) of the Indian Penal Code as well as Section 27 of the Arms Act and Sections 4/40 of Bihar Mining Act and Sections 33/41/42 of the Indian Forest Act. Allegation is that a mob of 52 persons attacked the informant, pelted stones and resorted to fire. The informant also fired from service revolver to disperse the crow but the informant and other police personnel sustained injuries. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of
Patna High Court Cr.Misc. No.54912 of 2016 (2) dt.23-12-2016 2/2 tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. Altogether 52 accused persons are named in the F.I.R. including the petitioner. General and omnibus allegation has been made. The other co-accused have been granted bail vide Annexure-2 series to the present application.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (M) P.S. case No.595 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
