2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 191 ( 2 ), 190, 109, 126 ( 2 ), 115 ( 2 ), 109, 74, 303 ( 2 ), 352, 117 ( 2 ) of the BNS.
3 . As per F.I.R., informant namely , Vijay chaudhary alleged that all the accused persons including these petitioners in an intoxicated condition came to the shop of informant and abused and assaulted son of informant and also took out Rs. 25,000/- cash from cash box and when son -in -law of informant came to save him, then co-accused Ajay Kumar assaulted him
Patna High Court CR. MISC. No.48864 of 2025(2) dt.21-07-2025 2/3 with iron rod. It is further alleged that accused persons also assaulted family members of informant and during the aforesaid incident, co-accused Ajay Kumar was apprehended on the spot.
4. It is submitted on behalf of these petitioners that petitioners are innocent and have falsely been implicated in this case . Specific accusation of assault is against co-accused Ajay Kumar who was apprehended on the spot and so far as these petitioners are concerned, they are only alleged to be member of mob and there is no specific allegation of any overt act is alleged against them. There is no injury report on record to substantiate the allegation of assault. Rest of the allegation is ornamental in nature . Petitioners claim clean antecedent. 5 . Learned counsel for the State oppose the bail petition .
6 Considering the nature of injury , clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned district and Additional sessions Judge Cum Exclusive Special
