JUSTICE RAKESH KUMAR ORAL ORDER 24-11-2016 Heard Sri (Dr.)Amrendra Kumar, learned counsel, who was assisted by Sri Ravi Shanker Pankaj, learned counsel for the petitioner and Sri Aditya Narayan Singh, learned Addl. Public Prosecutor.

The petitioner, who is named as one of the accused in Begusarai Mahila P.S. Case No.37/2016 registered for the offence under Sections 498(A), 323, 494 of the Indian Penal Code, has prayed for grant of anticipatory bail.

It was submitted by learned counsel for the petitioner that though it was alleged in the F.I.R. that the husband of the informant had solemnized marriage with the petitioner, this fact is not true. He submits that this fact also been mentioned in paragraph-8 of the petition.

Patna High Court Cr.Misc. No.48058 of 2016 (2) dt.24-11-2016 2/2 Be that as it may, keeping in view the fact that the petitioner is named accused in the F.I.R. with specific accusation, there is no reason to extend the privilege of anticipatory bail. The petition stands dismissed.

It goes without saying that if within six weeks from today the petitioner appears before the court below and makes a prayer for regular bail, the learned court below without being prejudiced with this order may examine the same and pass appropriate order in accordance with law preferably on the same day.
