The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 30(a), 32(ii) and 38(2) of Bihar Prohibition and Excise Act, 2016. Petitioner No.1, Rahul Yadav @ Rahul Kumar has already been arrested in the case. Hence, his prayer for anticipatory bail has become infructuous now. The recovery of liquor is alleged from the outer house, which is accessible by anyone. Petitioner has got no criminal antecedent.

No.64063 of 2018(4) dt.07-12-2018 2/2 the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount to the satisfaction of learned court below where the case is pending in connection with Sadar Police Station Case No.184 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
