Petitioner apprehends his arrest in connection with Barahara P.S. Case No. 236 of 2016 registered for the offences punishable under Sections 413 and 414 of the Indian Penal Code. Allegedly, one Honda Shine Motorcycle without number was recovered from possession of co-accused Arbind Kumar Singh and he stated that he has purchased the same for Rs. 5,000/- from the petitioner.
Submission is of false implication and that due to panchayat election there was rivalry between the co-accused and the petitioner, resulting, co-accused has stated the name of the petitioner. The petitioner has got no criminal antecedent and without any other material the petitioner is apprehending his arrest.
Patna High Court Cr.Misc. No.47235 of 2016 (2) dt.13-12-2016 Learned APP opposes the prayer of pre-arrest bail. In the facts and circumstances stated above, considering that the name of the petitioner has come in the confessional statement of co-accused and besides that there is nothing against the petitioner, the petitioner above named, in case of his surrender or arrest within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Barahara P.S. Case No. 236 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
