Petitioner apprehends arrest in registered for the offence punishable under Sections 326, 506/34 and other allied sections of the Indian Penal Code.

As per prosecution case, this petitioner assaulted on the head of the informant with Dabiya causing injury on his left finger.

Learned counsel for the petitioner submits that the petitioner is innocent. This case is counter blast of Alauli P. S. Case No. 294 of 2021. Both parties are gotiya and due to land dispute a simple altercation took place between them. It is next submitted that though as per FIR allegation of assault is by Dabiya but the injury has been found to be caused by hard and blunt substance. In the supervision report, the informant side

Patna High Court CR. MISC. No.42902 of 2022(2) dt.01-12-2022 2/2 was found aggressor. Petitioner has got clean antecedent. Learned counsel for the State opposes the prayer for bail application submitting that petitioner has caused grievous injury to the informant.

Considering the grievous nature of injury, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
