Petitioner is in custody since 30.06.2016 in connection with Dumaria P.S. Case No. 40 of 2016 registered under 147, 148, 149, 341, 504, 323, 324, 307, 325, 302, 448 and 380 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. Earlier the prayer for bail of this petitioner has been rejected by this Court with observation that petitioner may renew his prayer for bail after framing of charge. As per the report, which is at flag-B, case has already been committed to the court of Session Judge, Gaya on 25.04.2017 but till date charges have not been frame d in this case and the trial is not likely to be concluded in near future. The
Patna High Court Cr.Misc. No.52022 of 2017 (4) dt.31-01-2018 petitioner is rotting in custody for the last one year and six months. Moreover, similarly situated co-accused, Khurshid Ansari has already been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 52962 of 2017.
Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sherghati, at Gaya in connection with Dumaria P.S.
