The petitioners have preferred this application for grant of regular bail in a case registered under section 379 of the Indian Penal Code.

As per the prosecution case, the motorcycle of the petitioners which he had parked on his darwaja at night, was missing in the morning.

It is submitted by learned counsel for the petitioners that the FIR was registered against unknown. Referring to the order of the learned trial Court it is submitted that the name of the petitioners transpired in course of investigation when

Patna High Court CR. MISC. No.55596 of 2021(2) dt.05-04-2022 2/2 allegedly the stolen vehicle was recovered from the possession of the petitioner no. 1. It is submitted that contrary to the allegation no incriminating article has been recovered from the possession of petitioner no. 1. Petitioners have been falsely implicated in the case. They are in custody since 20.9.2021 and 19.9.2020 respectively and charge sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the nature of allegations, the petitioners being in custody for 6 months and 1 year 6 months respectively, the Court directs the above two petitioners to be enlarged on bail in connection with Bhairavsthan P.S. Case no. 126 of 2020 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-I, Jhanjharpur, Madhubani.
