JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 376, 341, 323 and 504/34 of the Indian Penal Code.

The prosecution case is that the informant was ravished by co-accused Md. Kaushar. At the time of incident, the informant was carrying pregnancy of five months. It is alleged against the petitioner that when the informant and her mother-in-law went to complain to the petitioner being the son-in-law of Md. Kaushar then he made assault to the informant and her mother-in-law. It is submitted by learned counsel for the petitioner that the thrust of accusation is against Md. Kaushar who has been acquitted vide judgment dated 17.09.2015 passed in S. Tr. No.407 of 2015. There is counter version of the occurrence also.

Kaushar who has been acquitted, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bhagalpur in connection with Pirpainty P.S. Case No. 281 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.

The bail bonds of the petitioner shall be accepted by learned court below on filing affidavit by the petitioner that he will regularly appear during trial. Two consecutive defaults by the petitioner will give liberty to the learned court below to cancel the bail bonds of the petitioner.
