The petitioner seeks bail in anticipation of his arrest in connection with Pasraha P.S. Case No. 72 of 2020, dated 02.08.2020, instituted for the offences under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner and another are said to have fired from their weapons, killing the husband of the informant.

Patna High Court CR. MISC. No.39395 of 2020(3) dt.08-12-2021 2/2 The reason for resorting to this violence is that the deceased had not withdrawn the name of his sister-in-law for being appointed as Anganbari Sevika/Sahayika.

Considering the nature of accusation against the petitioner, I am not inclined to accede to the prayer for granting anticipatory bail to him.

The prayer for grant of anticipatory bail to the petitioner is, accordingly, rejected.

However, if he surrenders before the Court below and seeks bail, the Court below shall consider the case on its own merits, without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.

The application stands dismissed.
