Petitioner is accused in Bodh Gaya Police Station Case No 424 of 2016 registered for the offence punishable under Section 302 of Indian Penal Code and Section 27 of Arms Act. Counsel for the petitioner submits that from perusal of the first information report itself, it would be obvious that the allegation of firing on the deceased (informant's wife) is upon the petitioner's nephew (son of brother). The petitioner has only been implicated in this case on the basis of suspicion since some altercations had taken place in respect to some land dispute between the informant and the petitioner who are brother-in-law and sister-in-law. Petitioner is in custody since 24.08.2017. She is a widow and it is submitted that she deserves sympathetic

Considering the aforesaid submission, prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Bodh Gaya Police Station Case No 424 of 2016 subject to the following conditions:
(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.
(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
