Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Sahebganj P.S. Case No. 223 of 2021 registered for the offences punishable under Sections 323, 341, 504, 308, 354, 379 and 34 of the Indian Penal Code.

As per the prosecution, the informant has alleged that this petitioner along with other co-accused persons armed with Lathi, Iron rod etc. came at his house and started assaulting him thereafter the accused persons also assaulted the daughter-in-law of the informant and tried to outrage her modesty. No.43028 of 2022(2) dt.22-11-2022 2/2 Mr. Ravi Ranjan appearing for the petitioner are that the petitioner is a young person having clean antecedent and has been languishing in jail since 14.08.2021 and against him investigation has been completed and as per the FIR the specific allegation is made against the co-accused Nagina Sahni who has been granted bail by a co-ordinate Bench of this Court vide order passed in Cr. Misc. No. 52231 of 2021.

Learned APP Mr. Jagdhar Prasad APP appearing for the State has opposed the bail prayer.

In view of above submissions and mainly taking into account the petitioner's custody period and his clean antecedent and nature of allegation appearing against him and also the fact that the investigation against him has been completed, in my view the petitioner deserves to a lenient approach of this Court. Accordingly, let the petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-15, Muzaffarpur in connection with Sahebganj P.S. Case No. 223 of 2021.
