2. In this case, the petitioner is seeking regular bail in connection with Special Case No. 135 of 2024 arising out of Kochadhaman P.S. Case No. 68 of 2024, registered for the offences punishable under Sections 420, 467, 468, 471 of the IPC and section 30(a), 32(3), 36, 41(i) of the Bihar Prohibition and Excise Act, 2016.

3. As per allegation, on a secret information, the police party reached the place of occurrence and intercepted a vehicle. On search, 389.49 liters of illicit liquor was recovered from that vehicle, to which the petitioner is driver.

4. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.46923 of 2024(2) dt.10-07-2024 2/2 that the petitioner is innocent and has falsely been implicated in this case. Though he is driver of the alleged vehicle but he was not aware with the consignment. He has submitted further that he is a person of clean antecedent and is under custody since 08.05.2024.

Considering the above-mentioned facts and circumstances as well as clean antecedent, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional District Judge II cum Special Judge (Excise-I), Kishanganj in connection with Special Case No. 135 of 2024 arising out of Kochadhaman P.S. Case No. 68 of 2024, subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
