Petitioner seeks regular bail in connection with Turkaulia(Raghunathpur) P.S.Case No.638 of 2017 instituted for the offence under Sections 30(a), 36 and 38 of Bihar Prohibition and Excise Act,2016.

The allegation is regarding recovery of 90 litres of illicit Nepali liquor and 7.5 litres of illicit foreign liquor from the outside of the house of the co-accused Bablu Manjhi. Petitioner is said to be apprehended while he along with other co-accused persons was throwing the said liquor.

The learned counsel for the petitioner submits that no recovery has been affected from the conscious possession of the

Patna High Court Cr.Misc. No.59473 of 2017 (2) dt.22-12-2017 2/2 petitioner. It is further submitted that the petitioner is having a clean antecedent languishing in custody since 10.10.2017. Considering the nature of accusation, the period of custody already undergone and the fact that the petitioner has got a clean antecedent, I direct the petitioner, named above, to be released on regular bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Motihari, East Champaran, in Turkauliya(Raghunathpur) P.S.
