1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Barahat P.S. Case no.3 of 2023 registered under sections 420, 406 and 34 of the Indian Penal Code.

3. As per the prosecution case, the informant states that the accused persons including the petitioner herein had taken Rs.38 lacs from the informant and one another on the pretext of getting them a Government job in the Forest Department.

4. Learned counsel for the petitioner submits that the allegations are false and concocted. Neither any promise of getting a job to the informant was made by the petitioner nor did

Patna High Court CR. MISC. No.45951 of 2023(4) dt.11-10-2023 2/2 he make any promise as alleged. He has been falsely implicated in the case. The petitioner is in custody since 25.3.2023 and has no criminal antecedent.

5. The application for bail is opposed by learned A.P.P. for the State and learned counsel for the informant. Learned counsel for the informant submits that some of the amount was given through Banking transaction through RTGS. Even the trial has commenced in the learned Court below.

Having heard learned counsel for the parties and taking into consideration the nature of allegation in the F.I.R., the investigation in the case having concluded and as per the informant's submissions, the trial having commenced together with the petitioner having remained in custody since 25.3.2023 and not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Barahat P.S. Case no.3 of 2023 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka.
