The petitioner apprehends his arrest in Gopalpur P.S. Case No. 117/2014, registered for the offences punishable under Sections 364, 120B and 34 of the Indian Penal Code. The informant made specific allegation against the petitioner and others that they kidnapped his brother and killed him.

It is submitted that the petitioner is a School teacher and on the date of occurrence he was on duty.

It is further submitted that other accused persons, namely Ashok Yadav, Mant Lal Yadav and Vilash Yadav were put on trial and they have been acquitted vide judgment and order passed in S.Tr. No. 836/2014/45/2015.

No.34313 of 2015 (4) dt.23-11-2015 2/2 Having considered the facts that there is specific allegation that the petitioner and others kidnapped the brother of the informant who is still traceless and the motorcycle of the brother of the informant was recovered from the house of the sister of the petitioner, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected. The petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order.
