The petitioner, who is in custody, seeks regular bail in connection with Imadpur Police Station Case No. 25 of 2017 registered for the offence punishable under Sections 307, 504/34 of the Indian Penal Code and Section 27 Arms Act. The allegation against the petitioner is that on his order his two sons fired upon the wife of the informant, on account of such firing she sustained injury and was referred to hospital for treatment.
Learned counsel for the petitioner submits for the same offence there is case and counter case and for the same incident petitioner has also lodged a case being Imadpur P.S. Case
Patna High Court Cr.Misc. No.49084 of 2017 (2) dt.18-10-2017 No. 26 of 2017 in which petitioner had also suffered injury. The dispute has arisen for construction of drainage. It has further been submitted that petitioner has no criminal antecedent and he is in custody since 27.06.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara, in connection with Imadpur P.S. Case No. 25 of 2017.
