Mr. Raj Kishor Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 14-12-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 188, 353, 120(B), 269, 270 and 283 of the Indian Penal Code read with Section 3 of the Epidemic Disorder Act and 3b of the Disaster Management Act.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that he got information by senior officers that petitioner who was a farmer leader has burnt the mannequin of Hon'ble Prime Minister and protested against the Farmer Bill with other people in the midst of corona pandemic, it is also alleged that

Patna High Court CR. MISC. No.43671 of 2022(2) dt.14-12-2022 2/3 when he reached the place of occurrence he was informed by the local people that petitioner along with 35-40 miscreants had committed the occurrence.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is next submitted that informant is not an eyewitness to the occurrence nor name of any local people who disclosed the name of petitioner is mentioned in the FIR, it is also submitted that no place or timing of the occurrence is given as such it appears that a false case came to be instituted merely because petitioner is a farmer, it is next submitted that petitioner has great reverence for Hon'ble Prime Minister.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Khagaria
