Mr. Ram Priya Sharan Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 07-06-2021 Heard Mr. Ajay Kumar Pandey, the learned Advocate for the petitioner and Mr. Ram Priya Sharan Singh, the learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Darauli P.S. Case No. 210 of 2019, instituted for the offences under Sections 341, 323, 353, 427, 409, 420, 504, 506 and 34 of the Indian Penal Code. The accusation against the petitioner is of not completing the construction of the building of Kasturba Gandhi Balika Vidyalaya even after accepting the full amount for the same.

The learned counsel for the petitioner has

Patna High Court CR. MISC. No.39661 of 2020(2) dt.07-06-2021 2/2 submitted that the F.I.R. has been lodged by the In-charge Principal of the school without verifying the facts. It has further been submitted that the regular Principal of the school has given a statement that the petitioner has already completed the work and there is no complaint with respect to the quality of work either.

Regard being had to the facts afore-stated, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Siwan, in connection with Darauli P.S. Case No. 210 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
