The petitioner being the brother's wife of the husband of the victim has renewed his prayer for anticipatory bail in a case registered for the offences punishable under Sections 302 and 120B of the Indian Penal Code. The accusation is of killing the daughter of the informant after one and half years of the marriage. It is submitted by learned counsel for the petitioner that the petitioner was separate from the husband of the victim when the victim performed love marriage. It is submitted by learned APP that during investigation it transpired that the husband of the victim had
Patna High Court Cr.Misc. No.54523 of 2015 (2) dt.29-06-2016 2/2 illicit relationship with this petitioner and at the behest of this petitioner the victim was killed. Now the prayer for anticipatory bail has been renewed on the ground that the husband of the victim has been acquitted.
Earlier the prayer for anticipatory bail of the petitioner was rejected vide order dated 22.01.2013 passed in Cr. Misc. No. 31803 of 2012. This Court is not inclined to revise the earlier order after more than three years. Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Bahadurganj P.S. Case No. 11 of 2012 pending in the court of learned Chief Judicial Magistrate, Kishanganj.
