JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 18-10-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Rajoun P.S. Case no. 140 of 2017 registered for the offence punishable under Sections 304-B and 328 of the Indian Penal Code. The petitioner along with other accused persons are said to have committed murder of the daughter of the informant over dowry demand of Rs. 20,000/- by administering poison to her.

It is submitted by the learned counsel for the petitioner that the petitioner happens to be father-in-law of the deceased. He never made any demand and has no concern with the aforesaid occurrence. He has been falsely implicated in the case as he happens to be family member of the husband of the

Patna High Court Cr.Misc. No.50359 of 2017 (2) dt.18-10-2017 deceased. The allegation levelled against the petitioner is not specific rather omnibus. The petitioner has been languishing in custody since 23.04.2017 Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Rajoun P.S. Case no. 140 of 2017.
