JUSTICE MADHURESH PRASAD ORAL ORDER 20-12-2017 Heard learned counsel for the petitioner and learned APP for the State.

This is a case registered under Sections 414, 276 of the Indian Penal Code and 18(C), 27(B) (ii) of the Drugs and Cosmetic Act.

The allegation relates to seizure of 20 cartoons of cough syrup from one vehicle. Petitioner claims to be a bystander in the bus stand.

Counsel for the petitioner submits that prior to the instant case there is no criminal antecedent of the petitioner. Other accused persons who are said to be the driver and cleaner of the vehicle have already been granted bail in Cr. Misc. No. 57049 of 2017 vide order dated 06.12.2017 and the petitioner is in jail custody since 31.08.2017.

Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge-cum-Special Judge, Purnea in K Hat P.S. Case No. 602 of 2017 subject to the conditions :

(i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.

(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
