Petitioner seeks bail in Bhabhua P.S. Case No.258 of 2018 registered for the offences punishable under Sections 420/467/468/34 of the Indian Penal Code.

Allegation against the petitioner is that he was purchaser of the disputed land from Kush Kumar and had executed sale deed in favour of the informant and three other persons but when they went to the Circle Officer office for mutation they came to know that they have no title over the said land and, as such, the case was registered for cheating, criminal breach of trust and misappropriation. Dispute appears to be of civil nature. Petitioner is in custody since 30.07.2018.

No.68345 of 2018(3) dt.30-11-2018 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Bhabhua P.S. Case No. 258 of 2018 with following conditions:- (1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be represented on each and every date fixed by the court.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
