JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420,465,467,469,471,149 and 120B/34 of the Indian Penal Code. The prosecution case is of lodging title suit and filing an unregistered deed therein by forging the signature of the informant.

It is submitted by the learned counsel for the petitioner that for the same cause of action an application was filed by the informant before the court where title suit is pending. Considering the fact that in pending title suit forgery has been alleged to have been made and statement made in paragraph 3 of the petition that the petitioner has no criminal

Case No.178 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
