The petitioner apprehends his arrest in connection with Maniyari P.S. Case No. 15 of 2018 registered under Sections 461 and 379 of the Indian Penal Code. The accusation is that, on 21.01.2018, at about 11.30 P.M., informant saw that some persons are committing theft in his grocery shop then he woke up and caught hold one person, who disclosed his name as Baiju Kumar, while others succeeded to flee away and Baiju Kumar also disclosed the name of his three associates including the petitioner.
Learned counsel for the petitioner submits that, in fact, Baiju Kumar, who is said to be caught hold at the time of
Patna High Court Cr.Misc. No.64213 of 2018(3) dt.31-01-2019 2/2 committing the theft in grocery shop of the informant, has disclosed the name of petitioner due to village politics, as petitioner could not caste his vote in Panchayat Election in favour of Amarjit Mahto, father of Baiju Kumar. Further submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Muzaffarpur, in connection with Maniyari P.S. Case No. 15 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
